FiraForm provides a headless form backend platform that allows developers and designers to:

• Create and manage form endpoints
• Collect form submissions from any website or application
• Configure validation rules and spam protection
• Receive notifications via email and webhooks
• Export and analyze submission data
• Manage domain whitelisting and security settings

3. User Accounts

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Collect personal information without proper consent
• Send spam, phishing attempts, or malicious content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others

Your Data: You retain all rights to the data collected through your forms. FiraForm acts as a data processor on your behalf.

Data Responsibility: You are responsible for ensuring your use of the Service complies with applicable data protection laws, including GDPR, PDPA (Malaysia), and other relevant regulations.

Data Retention: We retain your data as long as your account is active or as needed to provide the Service. You may request deletion of your data at any time.

6. Payment and Billing

Payment Processor: All payments are processed by Paddle.com Market Limited ("Paddle"), our merchant of record. By purchasing a subscription, you agree to Paddle's Terms of Use and Privacy Policy. Paddle will appear on your credit card or bank statement.

Fees: Some features of the Service may require payment. All fees are displayed at checkout and may be subject to VAT/sales tax depending on your location. Paddle handles all tax calculations and compliance.

Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually). By subscribing, you authorize Paddle to charge your payment method on file for recurring payments.

Price Changes: We reserve the right to change subscription prices. You will be notified of any price changes at least 30 days in advance. Continued use after the price change constitutes acceptance.

Refunds and Cancellations: Our refund and cancellation policies are detailed in our Refund Policy. In summary, we offer a 14-day money-back guarantee for new subscriptions. You may cancel your subscription at any time through your account settings or by contacting support.

Failed Payments: If a payment fails, Paddle will retry the charge. Your account may be suspended if payment issues are not resolved within a reasonable timeframe.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

8. Intellectual Property

The Service, including its software, design, trademarks, and content, is owned by FiraForm and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

You grant FiraForm a limited license to process and store your data solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, FiraForm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to FiraForm in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold FiraForm harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of third parties.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms or our Acceptable Use Policy
• Poses a security or legal risk
• Harms other users or the Service
• Results from non-payment of fees

Upon termination, your right to use the Service will immediately cease. You may request a data export within 30 days of termination.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

13. Dispute Resolution

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Entire Agreement: These Terms constitute the entire agreement between you and FiraForm regarding the Service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
